Fixes #9929.

What was wrong

gov.states.household.state_agis listed mt_agi_indiv as Montana's state AGI, and taxsim_state_agi (with its deprecated alias state_agi) added that list over the tax unit.

  • mt_agi_indiv is defined_for = "mt_married_filing_separately_on_same_return_eligible", which is false from 2024. So Montana's state AGI was 0 from 2024.
  • For 2021–2023, mt_agi_indiv floors each spouse's Montana AGI at zero before the sum. A joint return's Montana AGI is one figure that pools the spouses first, which PE computes as mt_agi_joint. So a spouse's loss never offset the other spouse's income.

Montana's income tax itself is unaffected: it already uses mt_agi_joint and the _indiv path directly. taxsim_state_agi is TAXSIM output mapping.

What the forms say

  • 2021–2023. 2022 Form 2, page 1 (2023 is the same):
    • Line 11 is federal AGI.
    • Line 14 is "Montana Adjusted Gross Income. Add lines 11 and 12, then subtract line 13."
    • Column B is "for spouse when filing separately using filing status 2a". A joint return therefore has one line 14 for the couple, and only status 2a gives each spouse their own.
  • From 2024. 2024 Form 2, page 1 (2025 is the same):
    • Line 1 is "Federal adjusted gross income from Form 1040, line 11".
    • Line 3 is "your federal taxable income for Montana"; line 7 is Montana taxable income.
    • There is no Montana AGI line.
  • 2024 instructions. PDF p. 5 (printed p. i) says taxpayers "must use their federal taxable income … as the base for calculating their Montana taxable income", and that "Montana's previous system used federal adjusted gross income". PDF p. 15 (printed p. 7) covers line 1.

What TAXSIM's state AGI column carries from 2024: federal AGI

The issue left open whether, from 2024, the state AGI column should carry federal AGI or PE's mt_agi_joint intermediate (federal AGI plus Montana additions minus subtractions). I ran NBER's own TAXSIM on the question. I used taxsimtest build 2025Aug23, the binary PolicyEngine/policyengine-taxsim bundles in resources/taxsimtest/, which covers years up to 2024. Its state AGI output (v32):

TAXSIM probe (MT) Federal AGI (v10) State AGI (v32) Montana taxable income (v36)
2022 couple: head wages 100,000; spouse Schedule C −20,000 80,000 80,000 (pooled) 64,400
2023 same couple 80,000 80,000 63,000
2023 single aged 70: wages 70,000, pension 30,000, Social Security 20,000, interest 5,000 122,000 121,200 (Montana AGI) 104,240
2024 single aged 70: wages 100,000 100,000 100,000 (federal AGI) 77,950 = 100,000 − 16,550 − 5,500
2024 single aged 70: as the 2023 single 122,000 122,000 (federal AGI) 99,950
2024 couple as above 80,000 80,000 50,800

Through 2023 TAXSIM reports Montana AGI, pooled on a joint return. From 2024 it reports federal AGI, even where Montana taxable income nets a subtraction (the 5,500 for a taxpayer aged 65 or older). It also matches how taxsim_state_agi already treats Colorado, North Dakota and South Carolina. The repo's own parameter files describe their bases as built from federal taxable income: the states_using_federal_standard_deduction references for Colorado and North Dakota, and the South Carolina comment in state_agis.yaml. For those states it reports federal AGI. So from 2024 Montana's state AGI is federal AGI, Form 2 line 1.

Probe inputs and outputs: ~/reviews/mt-taxsim-state-agi-2026-10-06/probes2.csv and probes_out_2025Aug23.csv.

Changes

  • mt_agi (new, generated in _generate_state_mfs_variables.py alongside mt_taxable_income): the Montana AGI of the filing path used. It is the sum of mt_agi_indiv when mt_files_separately, and mt_agi_joint otherwise. From 2024, mt_files_separately is always false, so it is mt_agi_joint.
  • state_agis.yaml lists mt_agi instead of mt_agi_indiv.
  • gov.states.household.states_using_federal_agi (new, dated) replaces the hardcoded FEDERAL_AGI_STATES list in taxsim_state_agi. It mirrors states_using_federal_standard_deduction.
    • From 0000-01-01 it holds the same seven states: CO, MI, MN, NC, ND, NM and SC.
    • Montana joins from 2024-01-01.
    • Every other state's result is unchanged.
  • taxsim_state_agi gets a documentation string stating the rule.

Household effects (state MT)

Pending: local runs of main and this branch are queued behind the machine-wide heavy lock; this section is filled in when they finish.

Tests

  • gov/states/tax/income/taxsim_state_agi.yaml (new): Montana cases whose expectations are TAXSIM's v32 values above, plus filing-path cases with direct inputs. (Result on main: pending.)
  • gov/states/mt/tax/income/mt_agi.yaml (new): both filing paths, pooling, the 2024 base, and zero outside Montana. (Result on main: pending.)
  • tests/core/test_mt_state_agi_invariants.py (new): a seeded grid of single filers and couples, one vectorized simulation per year for 2021–2027, plus Hypothesis-drawn batches (max_examples=5, derandomize=True). (Result on main: pending.)
  • test_legacy_state_umbrellas.py:
    • adds a Montana case to the umbrella-versus-component check;
    • adds a test that pins Montana's 2024 move to federal AGI for a filer aged 70, whose two measures differ.
  • Existing gov/states/tax/income/state_agi.yaml still passes.

Every file was run on its own, in the foreground, through ~/reviews/us-hub/scripts/heavy_run.sh at nice 0. The base runs used this branch's tests against upstream/main's source files. Logs are in ~/reviews/mt-taxsim-state-agi-2026-10-06/runs/.

Invariants (asserted in test_mt_state_agi_invariants.py for every tax unit)

  1. Filing path: mt_agi = the sum of mt_agi_indiv when the couple files separately on the same form, mt_agi_joint otherwise. From 2024 no unit files separately and mt_agi_indiv is 0.
  2. Reporting: taxsim_state_agi = mt_agi through 2023 and federal AGI from 2024. state_agi = taxsim_state_agi.
  3. Pooling: through 2023, a joint-path unit with non-negative federal AGI, no Montana additions or subtractions and no Social Security reports its federal AGI. This is the property main violates. Units with negative federal AGI are excluded: PolicyEngine floors Montana AGI at zero (an inherited convention), while TAXSIM v32 returns the negative amount (a 2023 single filer aged 40 with a $20,000 self-employment loss: TAXSIM reports -$19,999.99).

Test cost (hub build, macOS under heavy host load): test_mt_state_agi_invariants.py 8 passed in 369.5 s at 2.80 GB peak RSS; test_legacy_state_umbrellas.py 19 passed in 484.5 s at 2.64 GB peak RSS, reusing one simulation per legacy case.
4. Bounds: mt_agi ≥ 0. A unit outside Montana has mt_agi = 0.

Non-vacuity guards check that the grid reaches both filing paths through 2023, including a joint-path couple whose pooled AGI is below the floored sum. They also check that, from 2024, it holds a filer whose Montana base differs from federal AGI.

Coordination

Follow-ups

  • PolicyEngine/policyengine-taxsim overrides Montana's v32 to mt_agi_joint in every year (OUTPUT_ADAPTER_OVERRIDES in state_output_resolver.py, from policyengine-taxsim#901), as a workaround for this bug. Once a policyengine-us release carries this fix, that override should go. Otherwise the emulator reports 94,500 for the 2024 filer aged 70 above, where TAXSIM reports 100,000.
  • Arkansas and Delaware report the larger of their separate and joint AGIs, not the AGI of the filing path used. That is a separate chip.

axiom: n/a: TAXSIM output mapping. taxsim_state_agi and state_agis only map PE outputs to TAXSIM's state AGI column, and no Montana tax computation changes. mt_agi selects between two existing variables.

Hub microsimulation impact (current head)

A real microsimulation on the default dataset, main at the merge base 35f3c1f92a against this PR's head 3b249d67fc, for 2026. The runs went one at a time under the shared heavy-job lock. Sums are weighted.

Output 2026 change 2026 records changed (weighted)
taxsim_state_agi +63.07bn 947 (549,536)
state_agi +63.07bn 947 (549,536)
mt_income_tax +0 0 (0)
state_income_tax +0 0 (0)
income_tax +0 0 (0)
household_net_income +0 0 (0)
household_benefits +0 0 (0)

Variables this PR adds (mt_agi) have no value on the base side, so the table leaves them out.. state_agi and taxsim_state_agi now include Montana AGI, which is why they rise while Montana income tax does not change.

Comparison files are in fixes/9942-impact/ on the hub host.

taxsim_state_agi summed mt_agi_indiv for Montana. That variable is defined
only while Montana allows married couples to file separately on the same
form, so Montana's state AGI was 0 from 2024; for 2021-2023 it floored each
spouse's Montana AGI before adding, so a joint return was not pooled.

- Generate mt_agi: the sum of mt_agi_indiv when the couple files
separately on the same form, mt_agi_joint otherwise (2021-2023 Form 2,
page 1, line 14), and list it in state_agis.
- Move the federal-AGI state list out of taxsim_state_agi into the dated
  parameter gov.states.household.states_using_federal_agi, and add
Montana from 2024, when Form 2 starts from federal AGI and has no
Montana AGI line. TAXSIM reports federal AGI for Montana from 2024 too.

Context from the original session (local_99da947a), for the US + core hub, which owns this PR now. I won't push to the branch.

Evidence

  • TAXSIM ground truth for the YAML expectations is in ~/reviews/mt-taxsim-state-agi-2026-10-06/: probes2.csv and probes_out_2025Aug23.csv, run through NBER taxsimtest build 2025Aug23 from ~/PolicyEngine/pe-taxsim/resources/taxsimtest/taxsimtest-osx.exe.
  • The Opus review is in review-opus.md in the same folder.

My local base-versus-branch batch never ran. It was still queued for the heavy lock when the session ended. So these parts of the PR body are not yet true or still pending:

  • the "Household effects" table;
  • the "(Result on main: pending.)" lines;
  • the sentence "Every file was run … Logs are in ~/reviews/mt-taxsim-state-agi-2026-10-06/runs/". No such logs exist.

batch.sh in that folder runs everything in one hold: the branch, then upstream/main's source files with this branch's tests, then the branch again. If you reuse it, point R at the durable folder.

An in-session adversarial review (three lenses, two refuters per finding) upheld these findings on b04d4fb

  1. Blocking, fixed in 5c46dd4. mt_agi.yaml asserted mt_agi_indiv: [100_000, 0]. On main, loss_ald is split 50/50 between joint filers, which gives [90,000, 0]. Under Give each spouse their own above-the-line deductions in per-person AGI #9890 mt_loss_ald_reallocation keeps the equal split, so it is still [90,000, 0]. The assertion was dropped.
  2. Should-fix: PR body wording.
  3. Nit. taxsim_state_agi's new documentation says that non-federal states report state_agis. Arkansas and Delaware are special-cased to the larger of their separate and joint AGIs, so add that exception.
  4. Nit. states_using_federal_agi.yaml cites sources only for Montana. Either cite the other seven states (the CO/ND/SC conformity statutes are already in states_using_federal_standard_deduction.yaml), or say they carry over from the former hardcoded list.
  5. Nit. "2025 is the same" (PR body): the 2025 Form 2 has the same structure (line 1 federal AGI, no Montana AGI line), but its wording differs ("Form 1040, line 11b").
  6. Nit. test_mt_state_agi_is_montana_agi_then_federal_agi in test_legacy_state_umbrellas.py compares 2021–2023 against the whole state_agis list. That passes whichever Montana variable the list names. Use expected_vars = ["mt_agi"] and assert "mt_agi" in configured_component_vars("state_agis", year).

Follow-up chips filed (not in this PR)

  • Arkansas and Delaware report the larger of their separate and joint AGIs, not the filing path used.
  • Montana's 2021–2023 dependent-care deduction phases out on each spouse's mt_agi_indiv, even on the joint path.
  • policyengine-taxsim's Montana v32 override (mt_agi_joint in every year, from policyengine-taxsim#901) should go once a release carries this fix. Otherwise the emulator reports 94,500 for the 2024 filer aged 70, where TAXSIM reports 100,000.
