The LHA size-criteria benefit lists name only DWP benefits:
The law also names the Scottish devolved equivalents:
| Provision |
Devolved benefits listed |
| UC Regs 2013 Sch 4 para 12(3)(a) (overnight care) and 12(6A)(a) (disabled person) |
child disability payment (care component, middle or highest rate); Scottish adult disability living allowance (care, highest or middle); pension age disability payment; adult disability payment (daily living, standard or enhanced) |
| UC Sch 4 para 29(5) (shared accommodation exception) |
child disability payment; Scottish adult DLA; adult disability payment |
| HB Regs 2006 reg 2(1), "person who requires overnight care" and "member of a couple who cannot share a bedroom" |
all four |
policyengine-uk has no variables for these benefits. A Scottish recipient counts only where the data records them as DLA, PIP or attendance allowance.
Task
- Check how the enhanced FRS records ADP, CDP, PADP and Scottish adult DLA for Scottish respondents. The FRS benefit codes may differ by year.
- Either add variables for them and include them in both lists (and the HB "cannot share" definitions), or document how the DWP variables stand in for them.
- Cover the other provisions that list the same benefits, for example the UC carer element and the legacy premiums.
